Schema changes to Form 79bis. Business rule changes involving Directive 6Ra, Form 60 and Form 63. Changes to amendment options for Form 47.

Summary

On the Form 79bis :

  • A new validation has been added to the Form 79bis (Statement of Affairs) which will enforce question 7.2, 7.3, 7.4, 7.5, 7.6 to be mandatory if question 7.1 is answered "Yes" in the personal financial advice section. The new validation will also enforce question 7.2, 7.3, 7.4, 7.5, 7.6 to be empty if question 7.1 is answered "No".

Important Note on the Directive6Ra: The Directive6Ra version 2024-07 which came into force on September 16th, 2024, will no longer be accepted if the financial advice is populated. The enforcement for this form will be done by the E-Filing application, after the enforcement date of the changes outlined on this page. All previous versions to the Directive6Ra version 2024-07 will still need the financial advice information, if applicable.

Important Note on the Form 63: A soft copy of the Form 63 (Mediation Settlement Agreement) will no longer be requested if the Form 60 (Request for Mediation Made by Trustee) indicates that an agreement has been reached. Instead, an XML Form 63 will be required to be bundled with the Form 60.

Important Note on the Form 47: A new option “these amended terms were deemed accepted by creditors” has been added to the “Select reason for Amended Proposal” screen that appears when a subsequent Form 47 (Consumer Proposal), in XML or Softcopy format, is uploaded to a Division II administration.

The screen is adding a new option to the amendment section to allow for times where the creditors have agreed to new terms without an actual meeting having occurred, ie via email or other mechanisms.

Form 79bis If the value for <AdviceReceived> is "Received" we will be requiring that all fields in the <AdvisorInformation> be filled out. A Zero value must be provided when no dollar amounts available.

If the value for <AdviceReceived> is "Not Received", ensure that none of the fields in the <AdvisorInformation> have been filled out and that the <AdvisorInformation> is not included.
Directive6Ra Using the E-Filing business rules, we will be rejecting any fillings that include the deprecated <AdviceReceived> tag and any of the advisory information related tags. (Including: <AmountPaid>, <FurtherAmountCommitted>, <AdvisorPaidIndividual>, <AdvisorPaid>, <AdvisorPaidAddress>)

We will continue to require the <AdviceReceived> information be provided on previous versions of the Directive6Ra.
Form 63 The Form 63 (Mediation Settlement Agreement) will now be required to be sent to OSB in XML format when a Form 60 (Request for Mediation Made by Trustee) is submitted with the <MediationAgreementReached> field set to true.

  • the terms of the proposal have been altered; the original proposal has not yet been sent to the creditors.
This is an amendment to the terms of the proposal:

  • these amended terms have not yet been accepted by the creditors.
The new options will be:
