Directive 8R12: Updates to Form 10, Form 31, Form 37, and Form 49 and new Form 37.1 (2011-03)

Summary

This is an updated edition of the schema for E-Filing version 4.11. It documents schema changes resulting from Directive 8R12.

Changes have been made to Form10, Form31, Form37, and Form49 and there is a new form Form37.1. A new unique XML version number is to be used, 2011-03. This new XML version will be put into place on June 27, 2011 and will be enforced on September 23, 2011.


Form 10, Application of Trustee for Discharge (Rule 61 and subsection 66(1) of the Act)

Form 10 has some minor formatting changes.

Form 31, Proof of Claim (Section 50., subsections 65.2(4), 81.2(1), 81.2(3), 81.4(8), 102(2), 124(2), 128(1), and paragraphs 51(1)(e) and 66.14(b) of the Act)

Form 31 The following fields from the schema have been deprecated: <RequestMaterialChange>, <RequestSurplusIncomeInfo>, <RequestInfoIfNoSurplus>. The existing field <RequestAmendmentChange> is to be used in all applicable cases instead.

Form 49, Notice to Creditors of Consumer Proposal (Paragraph 66.14(b) of the Act)

Form 49 has had a reference to the new Form 37.1 added.

  • The following fields from the schema have been deprecated: <RequestMaterialChange>, <RequestSurplusIncomeInfo>, <RequestInfoIfNoSurplus>. These fields are kept only for backwards compatibility with previous versions, do not use them; they will not render on the current version of the form. The existing field <RequestAmendmentChange> is to be used in all applicable cases instead.
  • The new text: "Whenever the trustee reviews the financial situation of a bankrupt to redetermine whether or not the bankrupt is required to make payments under section 68 of the Act, I request to be informed, pursuant to paragraph 68 (4) of the Act, of the new fixed amount or of the fact that there is no longer surplus income." will be rendered when the <RequestAmendmentChange> field is selected

  • Added the text "(Note: Form 37.1, Voting Letter, may be used by the creditor to indicate assent to or dissent from the consumer proposal and to request that a meeting of creditors be held)" to paragraph 3.
