Specific Rules to be Incorporated for New Legislation

Form47.xsd:

  1. The submission will no longer be returned if the Trustee indicates "an Amendment to the Terms of the Proposal, not yet reviewed by Creditors", and the accompanying EIS.xsd does not have the Creditor Meeting entry.

Form79.xsd:

  1. Return the submission of the Div II Proposal if the total liability per each debtor in the filing is greater than $250,000. For example, for a single debtor the limit is $250,000, for a joint filing with two debtors, the limit is $500,000, and for a filing with three debtors, it would be $750,000.

Form84.xsd:

  1. Return the submission if an Automatic Discharge option is selected and the EIS.xsd indicates that the bankrupt has more than one prior bankruptcy. This is a change from the existing rejection rule where eFiling would reject a Form 84 submission if there was any previous bankrupt indication on the EIS.xsd.
  2. Return the submission if an Automatic Discharge option is selected and there is an accompanying 170 report that indicates that the bankrupt has High Income Tax debt.
  3. Return the submission if the conditions determined by the prior bankruptcy count and/or the Surplus Income indicator does not correspond with the option selected for the Automatic Discharge on the Form.
  4. Return the submission if there is an inconsistency between the Form84.xsd selection option for Automatic Discharge and the option selected on the Form 68 (Notice of Impending Automatic Discharge of Bankrupt).

All Prescribed Forms:

  1. Any existing eFile rules will be modified in such a way to be consistent with the coming into force date. For example, Form 85 - Certificate of Discharge (Conditions Met) has been repealed, as it has been combined with the Form84 as part of the paper burden initiative. As such, if a trustee files a Form85 on an Estate whose filing date is after the coming into force date, it will be returned. Similarly, if a trustee files the new version of the Form 84 on an Estate whose filing date is before the coming into force date, it will be returned.
  2. As the coming into force is always based on the Filing date of the Estate, any Form submission from the Trustee that is using the wrong version (based on filing date) will be returned. For example, if the CIF date is November 1st, 2008, and on November 2nd, the Trustee files a 170 report using the new version of the XML for an Estate Filed in February 2007, it will be returned.
