Colour claim

Colour is claimed as a feature of the trademark. The shrimp design is black. The ribbon-like antennae encircling the shrimp design begin black as they exit the top of the shrimp design, and then quickly fade to brown and then light brown then to red, all within the top portion of the design. The antennae are thereafter red. The Japanese characters on the left side of the shrimp and the words 'TEMPURA EBINOYA' are black. The small square at the bottom of the Japanese characters and beside the word 'EBINOYA' are red with white Japanese characters within.

Foreign Character Translation

As provided by the applicant is 'TEMPURA' is a type of Japanese food. 'EBINOYA' and 'FU' have no dictionary meaning in any language.

Foreign Character Transliteration

As provided by the applicant, the transliteration of the three small Japanese characters just to the left of the shrimp design is 'TEMPURA'. The transliteration of the four larger Japanese characters on the left is 'EBINOYA'. The transliteration of the Japanese characters in the red square background on the lower left-hand corner of the Japanese characters and the lower right-hand corner of the word 'EBINOYA' near the bottom of the design is 'FU'.
