Different fees must be paid during the patent application process, and after a patent is granted. The amount of those fees is shown in the lists below.

Annual fee adjustment

fee adjustment: On , the fees for the services outlined below will increase by 6.8%, in accordance with the Service Fees Act. Note that not all fees are subject to the annual adjustment.

As a result of this fee adjustment, the amounts shown in the Tariff of Fees in Schedule 2 of the Patent Rules may not be up-to-date.

Fee adjustments – what fee do I pay?

For fees subject to an annual adjustment, the fee amount you must pay depends on the date which the fee is received by the CommissionerFootnote 1, not the date which the service was originally requested, nor the prescribed date to pay the fee.

How to determine what fee to pay

For all fees subject to an annual adjustment:

  • If payment is received before January 1 of next year, you will need to pay the prescribed fee for the current year.
  • If payment is received on or after January 1 of next year, you will need to pay the adjusted prescribed fee for next year.

For example, if you file a patent application but your filing date is not granted because you failed to pay a prescribed fee, the amount you need to pay will depend on the date which the Commissioner receives payment of your entire prescribed fee.

Similarly, the amount due for a maintenance fee depends on the date which your payment is received, not the prescribed date to pay the fee. This applies whether the fee is paid early, during the late fee period, or during the reinstatement period.

As a result of amendments to the Patent Rules (SOR/2022-120) that come into effect on , certain fees have been modified or added.

    • The basic fee (except for the small entity fee applicable when the application has been subject of an international search by the Commissioner) has been modified
    • A fee for each claim in excess of 20 included in the application on the day that examination is requested has been added
  • A fee for continued examination of an application has been added
  • A fee for requesting withdrawal of an application from allowance and returning to examination has been removed
  • Final fee
    • The basic fee has been modified
    • The excess page fee has been modified
    • A fee for each claim in excess of 20 that has not been paid when examination was requested has been added
