Searches against (all the search fields in the database)

Trademark lookup

Searches against (trademark title, trademarks description, index heading, foreign character [national translation or transliteration], foreign character translation [word mark translation text] or foreign character transliteration [word mark] and GI translation).

This setting will simultaneously query all the aforementioned fields. Consequently, this setting allows the user the convenience of being able to query all the fields which are relevant to looking up a particular trademark.

Application number

The number that is assigned to a trademark application.

This search field, searches against (number assigned to trademark application without leading zeros, or without extension counters, and can be searched as a list separated by comma, space or using the Boolean operator "OR" between each number).

Original application number

The number of an application for the registration of a trademark which has been limited for the purpose of filing a divisional application.

Searches against old application number (i.e., initial or divisional application numbers). Searches application numbers without leading zeros, without extensions and can search a list separated by spaces (OR) search.

Registration number

The number assigned to a trademark when it becomes registered. The number is preceded by an abbreviation for the name of the act under which it was registered (ATM for an Act Pertaining to Trademarks, TMDA for Trademark and Design Act, UCA for Unfair Competition Act, NFLD for Newfoundland Act, and TMA for Trademarks Act). When you use this database only the number is needed. If several trademarks have the same registration number but are registered under different acts, the list that the database generates will give you all the trademarks that have that number.

The search engine searches against (registration number with or without leading legislative abbreviations "TMA, TMDA, UCA, NFLD".

International registration number

The number assigned to an international registration. Searches against (international registration number with 7 numerical digits).

Current owner name

The name of the most recent owner registered with the Trademarks Office. See also registrant. Searches against legal current owner, applicant name or registrant's name.

Old owner name

The name of the previous owner registered with the Trademarks Office.

Searches against registrant name, if not the current owner, or if not previous owner. Searches against applicant name if not the registrant, or not the previous owner name and if not the current owner.

Old and current owner name

The name of the previous or the most recent owner registered with the Trademarks Office. The search engine searches for the combined current and old owner names as described above.

Trademark

This is the trademark itself and can consist of words, designs, tastes, textures, moving images, mode of packaging, holograms, sounds, scents, three-dimensional shapes, colours or a combination of these.

Trademark description

This is a written description of what the trademark consists of. A description is required for certain non-traditional trademarks. Foreign character translation/transliteration

Where a trademark includes foreign words and characters, it must be translated into English or French. This field is used to search for this translation.

Where a trademark includes foreign characters (such as Chinese, Korean, Arabic, Cyrillic, etc.), it must be transliterated into Latin characters. This field is used to search for this transliteration. The search engine searches for foreign character translation (word mark translation text), (translated TM representation text), word mark (translation text), word mark (specification, representation transliteration text).

Index heading

Index headings identify all word components of the trademark. Searches against (index heading text).

Goods

The goods field contains all the goods related to a trademark. The goods are shown in the official language in which they were submitted. Therefore, you may want to look up the same goods in both official languages (English and French).

Services

The services field contains all the services associated with a trademark. The services are shown in the official language in which they were submitted. Therefore, you may want to look up the same services in both official languages (English and French). Searches against services description (statement text) and not the Nice class description.

Goods and services

The goods and services field contains all the goods and services associated with a trademark. The goods and services are shown in the official language in which they were submitted. Therefore, you may want to look up the same goods and services in both official languages (English and French). Searches in the same manner as described in goods and in services above.

Nice Classification

The Nice Classification groups goods and services into 34 classes of goods and 11 classes of services. Each class has a heading that provides a general indication of the fields in which a good or service belongs. There are also explanatory notes for the class headings that provide additional information on the types of goods or services that can be included within a specific class.

Class 0 – Goods and services not classed.

Current CIPO status

This field allows you to search specific current CIPO status terms. Whether it is in an active or an inactive state.

Searches for any but not all of the following current CIPO status terms:

  • Pending
    • Pre-formalized, formalized, default – searched, approved, accepted for publication, advertised, opposed, searched, refused – awaiting appeal, refused – appeal in progress, registration pending, default – registration pending
  • Registered
    • Approved, advertised, registered, granted, entered on the list, protected
  • Inactive
    • Abandoned section 36, abandoned section 40(3), refused, expunged, cancelled by owner, withdrawn, inactive – partial transfer, merged, abandoned, withdrawn by owner, abandoned – section 38(7), surrendered, removed, cancelled, expunged section 45(3), refused in accordance with Trademarks Opposition Board decision, inactivated, revoked, deemed never filed.

Disclaimer

Sometimes an applicant has disclaimed the right to the exclusive use of one or more unregistrable parts of a trademark. This field allows you to search disclaimed subject matter. For example, when you are searching for trademarks in which the word "ultra" has been disclaimed, and you input the word "ultra" in this field, you will find trademarks for which the word "ultra" has been specifically disclaimed. You will not find trademarks that include the word "ultra" for which the disclaimer statement reads as follows: "The applicant disclaims the right to the exclusive use of all of the reading matter apart from the trademark" and other similar disclaimers.

Vienna codes

The Vienna code classification is an international standard for categorizing trademark designs by their figurative elements. The Vienna classification consists of a hierarchical system that moves from the general to the specific, dividing all figurative elements into categories, divisions and sections. (Not all "sections", can be filtered or broken down further to auxiliary).

For example, the "hands" is a figurative element with the classification codes for "category" 2 human being, followed by "division" 2.9 parts of the human body, and then, "section" 2.9.14 will find the "hands" as part of the figurative element.

When a figurative element is making a gesture or share further decompositions that's when the "auxiliary" could factor in the classification. For example, is the hand open with palm up or down, is the hand giving a thumbs up or thumbs down?

Vienna codes description

This field allows you to search words within the written description of the figurative elements in the Vienna classification.
