Introduction

Overview

This training aims to provide Nuans members with key information on using Nuans effectively. The tips and guidelines included here will help you understand how inputs will influence the search behavior and obtain the best possible results.

Users accessing Nuans through the simplified self-serve application benefit from the same search capabilities as the members' application but some functionalities may not be available, and the display may also be different.

The following sections do not apply to self-serve users:

  • Dashboard – selecting jurisdictions and interpreting results
  • Order a report – report type, alternate spellings or phonetics, specifying goods and services and client reference number
  • My report – order multiple reports, surveil trademarks, recover reports, and manage my account

The display may also differ for members accessing Nuans services through their own interface.

Nuans is an automated search tool that enables users to determine similarities between a proposed name with businesses and trademarks that are currently registered. Nuans presents search results in a report that reveals identical and potentially confusingly similar names.

Before clients order a Nuans corporate report, they can perform a pre-search of the proposed name to see if it has already been registered. Once a client orders a report, the proposed corporate name is reserved in the Nuans database for 90 days.

Nuans also offers a trademark surveillance service that provides trademark agents with a tool to determine whether a newly advertised mark is in conflict with one of their clients' trademarks.

Elements of a name

Most names are composed of 3 elements:

  1. A distinctive element that is the main identifier of the business
  2. A descriptive element that describes the nature of the business' main activities, and
  3. A legal element that indicates that the business is an incorporated body

Choosing your proposed corporate name

Federal, provincial and territorial laws protect the names of existing businesses against proposed corporate names to avoid confusion.

Each name granting jurisdiction (federal, provincial and territorial) has slightly different guidelines and views on what constitutes a confusingly similar name. Proposed corporate names must always meet the requirements and regulations applicable to the jurisdiction in which a business is incorporating.

Obtaining a Nuans corporate name search reservation report does not mean that your proposed corporate name has been approved:

  • You must submit your report to the responsible jurisdiction in which you are applying.
  • The jurisdiction will review the report and make a decision on your proposed corporate name.

Nuans users are responsible for familiarizing themselves with the acts and regulations of the jurisdictions for which they are conducting name searches.

Search specifications

General concepts

Upper and lowercase characters

Nuans does not distinguish between upper and lowercase characters. In other words, searches are not case sensitive.

Accented characters

Nuans does not distinguish between characters with or without accents. A search for "été" will also find "ete", "éte", "eté" and "été".

Punctuation (. , ? ! : ; -  " () ' [] / …)

When Nuans encounters punctuations, it is generally interpreted as a space.

However, periods (.) or hyphens (-) are treated in 2 ways:

  1. Nuans will search the word with the characters combined and the punctuation removed.
  2. Nuans will search the word with a space replacing the periods or hyphens.

If a name is entered as: STATE-OF-THE-ART COMPUTER REFITTING.COM

It will be interpreted as: STATEOFTHEART COMPUTER REFITTINGCOM and STATE OF THE ART COMPUTER REFITTING COM

Another example: F.A.I.T.H. will be interpreted as FAITH and F A I T H

Spaces

Leading, trailing and double spaces within a proposed corporate name will be removed. For example:

  • If a name is entered as: THE    FRESH    MARKET
  • It will be revised to: THE FRESH MARKET

Plural and singular words

Nuans treats singular and plural words equally by ignoring the final S if one form exists. For example, the words COOKS and COOK would be treated as equivalent.

Numbers

Nuans automatically searches for words containing digits and their alphabetic equivalent (1-1000) regardless of the 2 forms entered (for ex., FOUR or 4).

Long names without spaces

For names without spaces, using the double pipe (|| ) operator character can help Nuans identify individual words within the long string.

For example: ROUNDABOUTSOLUTIONS = ROUND||ABOUT||SOLUTIONS

Search capabilities that are out of scope

It is important to understand which Nuans search capabilities are out of scope. For this reason, note that the search will not:

  • Find the equivalent of English and French terms (for ex., cloud will not find "nuage")
  • Find characters other than Latin characters. (for ex., foreign-language characters such as "ݽ ")
  • Find individual words embedded in larger terms other than:
    • 7 or more character match within a term of up to 100 characters (for ex., modernhabitat will find habitat)
    • 5 character match within a 6 character term (for ex., eBOARD will find board)
  • Apply phonetic match to terms of 3 characters or less (for ex., psi will not find psy)

Dashboard

The Nuans member's application consists of a dashboard where users have access to a choice of 8 different Nuans products and services described below.

Do a pre-search

The pre-search function allows you to check if a proposed corporate name already exists in Nuans. To do a pre-search, click on Do a pre-search from the dashboard.

The pre-search will look for existing businesses and/or trademarks that include all terms identified in the Enter a corporate name field. Pre-search will not find names that are phonetically or visually similar.

Pre-search does not replace ordering a Nuans report, but it can be useful to perform one first.

To conduct a pre-search, enter the terms that you wish to search in the Enter a corporate name field (you can also search by corporation registration number or trademark application number), identify the scope of the search and press the Search button.

Search term

Because a pre-search will search for names that exactly match the words in the search term, the way you formulate the search term will have a direct impact on the search results. For example:

  • AIR CADET LEAGUE OF CANADA INC.

but would not match:

  • CANADIAN AIR
  • AYRE CANADA
  • AIR FREIGHT

Because the search term is not case sensitive, the search term AIR CANADA would be treated equivalently if entered as Air Canada or air canada.

Characters accepted in pre-search

Search terms can contain letters, numbers, special characters and punctuation, such as HIGHWAY 49 SNACK SHOP or TIM'S DI$COUNT AUTO$.

Search term word limit

There is no word limit for pre-searches. However, it is recommended to specify fewer search terms for simplicity and performance.

Legal designations

Do not include legal designations, such as INC.CORP., or LTD. in the search term.

Getting better results

For more useful results, do not include words in the search term that are very common, such as CONSULTING. Matches to these common words could swamp the results and obscure matches to the distinctive part of the proposed corporate name. You can also pre-search phonetically similar words in order to uncover more possible conflicts.

Using wildcards in the search term

The asterisk (*) will match a string of charactersIt can be used at the beginning, middle or end of a word. Note that the asterisk will also match no characters.

Search term

The question mark (?) will replace one characterThe results will present an exact match of all other letters in the search term except the question mark itself.

For example:

Using operators in the search term

The "AND" double ampersand operator

To require that a search match all of the words in the search term, separate the words with a space or double ampersand characters ( && ). This will be treated as an implicit "and" statement. For example:

AIR && CANADA is equivalent to AIR CANADA (the search must match AIR and CANADA) and would match:

  • AIR CANADA
  • AIR CADET LEAGUE OF CANADA INC.

The "OR" double pipe operator || )

To require a search to match any of the words in the search term, separate the words with double pipe characters ( || ). For example:

AIR || CANADA would match:

  • FIRST AIR
  • CANADA FURNITURE IMPORTERS

in addition to:

  • AIR CANADA
  • AIR CADET LEAGUE OF CANADA INC.

Using multiple logical operators

Multiple logical operators can be combined in a search term, (for ex., JCP && CAPITAL || FINANCE). Search terms and operators are evaluated from left to right and the operators are given equal weight. For example:

JCP CAPITAL || FINANCE would match:

  • JCP CAPITAL
  • JCP FINANCE

but would also match:

  • BRISTOL FINANCE

Advantage of parentheses with multiple logical operators

Parentheses "()" are recommended when you use multiple operators. The parentheses separate and group words in the search term when conducting a pre-search to introduce more complex logic. For example:

Search term
JCP (CAPITAL || FINANCE) would match:

  • JCP CAPITAL
  • JCP FINANCE

but would not match:

  • BRISTOL FINANCE

To keep searches simple, it can be preferable to conduct multiple searches with simple search terms, rather than one search with complex search terms.

Phrase searching

To have search terms interpreted as a phrase, enclose them in double quotation marks (" "). A phrase search means that the search terms must be next to each other and in the same order in the results. It will also find matches that include punctuation or symbols between the search terms. For example:

Phrase search term
"AIR CANADA" would match:

  • AIR CANADA
  • AIR-CANADA

but would not match:

  • AIR CADET LEAGUE OCANADA INC.

Phrase search terms can contain wildcard characters, but each word in the phrase cannot begin with a wildcard character. Note the following examples:

Valid queries:

  • "air canada"
  • "ai? cana*"
  • "a?r canada"
  • "air can*da"

Invalid queries:

  • "*air canada"
  • "?ir canada"
  • "?ir?anada"
  • "*ir *anada"

Tips – Pre-search

Words ending with the letter S or S'

When conducting a pre-search for a search term that includes a word ending with S or S', enter the word as ending with the letter S. Even if the proposed corporate name has an apostrophe (S'), you do not need to type it. All businesses or trademarks name ending in S or S' will appear in the results, For example:

but would not match:

  • PEOPLE'S CHOICE

Plural and singular searching

When conducting a pre-search, Nuans will not find singular and plural forms of the word. For example:

  • GUYS SERVICES

but would not match:

Searching the plural and singular version of the term with the double pipe (||) search operator will match all variables.

Pre-search is incapable of searching for the plurals of X, -ing and -ies.

Initials

When conducting a pre-search for a proposed corporate name that contains initials, enter one set of initials without spaces and another set with spaces between double quotation marks. Separate both sets with the double pipe (||) and use the parentheses "()" to group the initials together. For example, if MILDRED'S B&B is the desired search:

  • MILDRED'S BB
  • MILDRED'S B+B

When the proposed corporate name contains 3 or more initials, use the same search string as above and do this for all possible initial spacing scenarios. For example, if XYZ SERVICES is the desired search:

  • XY & Z SERVICES
  • X.Y. Z. SERVICES

Homophones

You can benefit from searching for words that are spelled differently but sound the same (homophones). For example, if D-TWO ENTERPRISES is the desired search:

  • D-TWO ENTERPRISES
  • D2 ENTERPRISES
  • D & D ENTERPRISES
  • ENTERPRISES DOUBLE D

Adding search terms like DD, D2 or DII could also be beneficial when ordering the report. For more information, see Alternate spellings or phonetics.

Bilingual names

If the proposed corporate name is bilingual and it is desirable to present both English and French pre-search results together, a bilingual search can be conducted by specifying both the English search terms and French search terms together. For example:

  • LAURENTIAN PAPER
  • PAPIER LAURENTIEN

Merged/Linked words

Occasionally, a search term will contain 2 or more words that are attached (without spaces). When entering the search term, enter it whole and separated. For example, if NORTHSTAR is the proposed corporate name, the search term should be entered as follows:

Selecting jurisdictions

During a pre-search, it is mandatory to specify the scope of the search with the following fields:

  • All company names and trademarks contained in Nuans (Select all)
  • Federally registered company names (Federal)
  • Provincially/territorially registered company names (for ex., Alberta)
  • Company names that are reserved in Nuans (for 90 days) but are not registered yet (Proposed corporate names)
  • Registered trademarks (Trademarks).

Interpreting results

No matches found

If the pre-search does not find any exact matches to the proposed corporate name, a message will appear and inform the user of the result that no matches were found.

You can:

  • Change your search criteria by pressing the Refine search button
  • Conduct another pre-search by pressing the Search for another name button
  • Order a report based on the search criteria by pressing the Order a report button or
  • Return to My reports by pressing the Cancel button.

Matches found

If the pre-search does find one or more exact matches to the proposed name, the matching names will appear in a table for the user to review.

By selecting a name in the table, additional details about the matching name will be displayed.

You can:

  • Change your search criteria by pressing the Refine search button
  • Download the search results in PDF format by clicking the down arrow next to Download search results as PDF
  • Conduct another pre-search by pressing the Search for another name button
  • Order a report based on the search criteria by pressing the Order a report button or
  • Exit pre-search by pressing the Cancel button.

Order a report

If you want to order a Nuans corporate name search report, click on Order a report from the dashboard.

Nuans uses a set of different search filters to generate reports. These filters directly influence the search results.

If you want to order more than one report, select Order multiple reports from the dashboard.

Ordering a report is a two-step process. To complete the first step, select a report type, enter the proposed corporate name that you wish to search for and press the Next button.

You can also specify alternative spellings, the distinctive term, any desired client reference, business activities and the products and services sold by the company before proceeding to the next step.

The second step consists of confirming that the information that you entered is correct.

Once you order a report, you will receive confirmation of the order and be notified of the completed 90-day period reservation. The proposed corporate name will be reserved in Nuans.

Once you order a report, a notification confirming the order will appear.

To view the ordered report, press My reports button at the bottom of the notice.

Trademarks cannot be reserved through Nuans. Visit the Canadian Intellectual Property Office to find out more about how to register trademarks.

Ordering a report does not mean that the proposed corporate name has been approved.

Report type

When ordering a report, it is mandatory to specify which type of report you want to order from the drop-down list.

It is important to select the correct report type and recognize that reservation and inquiry reports are used for different purposes.

  • reservation report will add the proposed corporate name in the Nuans database and generate a report consisting of similar businesses and trademarks. The proposed corporate name is reserved for a period of 90 days. You must submit your reservation report to the responsible jurisdiction when registering or incorporating.
  • An inquiry report is for research purposes. It will also generate a report consisting of similar businesses and trademarks. However, the name searched will not be added to the Nuans database, will not be reserved and the report cannot be used for registration or incorporation purposes.

When ordering a report, it is mandatory to specify a proposed corporate name.

The proposed corporate name will be added to the Nuans database. Nuans will search in its database to find existing businesses and trademarks containing each of the words specified in the proposed corporate name.

Use the following tips to formulate your query to obtain the most relevant results on the report.

Legal designations

As a general rule, do not enter the legal designator in the proposed corporate name because it does not make a corporate name more distinct.

If you enter a legal element and no distinctive term is identified, each term in the proposed name will have the same weight, including the legal element and the search results could be greatly impacted.

The jurisdictions of AlbertaOntario and Saskatchewan require that the legal designator(s) be included on the Nuans report.

Common words or symbols

The following words and symbols are very common and will be attributed a lower weight factor, except when identified specifically as either a distinctive term or an alternate spelling or phonetic.

Search operator

Double pipe (||) can be used to identify individual words in long proposed corporate names not separated by spaces.

Please note that the operator will be present in the query but will not be reflected in the name reserved in the Nuans database.

No other search operator can be used in a proposed name to order a report.

Distinctive term

A distinctive term sets a corporate name apart from that of other businesses offering the same goods or services. The distinctive term is the most important part of your name in order to reduce confusion with similar businesses that already exist.

Identifying the distinctive portion of a proposed corporate name is the most important decision that a Nuans user must make to obtain the best possible search results!

Here are the main reasons for identifying the distinctive portion of a proposed corporate name:

  • The distinctive term will be emphasized in business name searches
  • The distinctive term will be more focused in trademark searches
  • Nuans will consider the whole name as being distinctive when no distinctive term is identified in the proposed corporate name, therefore each term in the name will have the same weight, even the legal designator.

The distinctive term must be part of the proposed corporate name.

Nuans does not limit the number of distinctive terms.

Multiple distinctive terms must be separated with a space.

Avoid including conjunctions, prepositions, articles or common words in the distinctive term as they may overwhelm the results.

In most circumstances, a single word in the proposed corporate name is the distinctive term, as in this example:

However, there are situations where 2 words are required to create uniqueness. In these situations, select both words as the distinctive term. For example:

Surnames and first names

If a proposed corporate name includes a surname, but no first name, specify the surname as the distinctive term. For example:

If the proposed corporate name includes a first name, but no surname, specify the first name as the distinctive term. For example:

Multiple distinctive terms

For a proposed corporate name that includes multiple distinctive terms, be advised that each identified distinctive term will be treated equally. Each term will have the same weight regardless of its order in the corporate name.

When searching multiple distinctive terms, do not include special characters as they influence the results. For example:

Nuans will search for variations of CHRISTIE + PALMER, as well as PALMER + CHRISTIE. It will also find CHRISTIE + CONTRUCTION and PALMER + CONTRUCTION.

Coined words

Coined words appearing in the proposed corporate name should be cited as the distinctive term. For example:

Short words

Names with very short distinctive terms usually require additional consideration before searching. In the example below, even if the word "TRAVEL" describes the activities of the proposed corporate name, including it in the distinctive term will prioritize results that include both terms. In this case, not including the word "TRAVEL" in the distinctive term may impact the results in the report.

Initials

Considering that words are searched both grammatically and phonetically, three-letter words or less are considered initials and are not searched phonetically.

If initials are followed by a descriptive term, identify them as the distinctive element. For example:

When initials are used with a surname and a descriptive term, do not identify the initials in the distinctive term. Including the initials would be the equivalent to searching for multiple distinctive terms. For example:

Common descriptive words

Common descriptive words should not be identified as the distinctive term of the proposed corporate name, as these words could overwhelm the search results. For example:

Phrases and long names

When it comes to searching phrases, it is not always easy to distinguish a specific portion as being distinctive; they are either all general or all distinctive. The best approach is to identify all the words that comprise the phrase as the distinctive term. For example:

If the proposed corporate name of a not-for-profit organization includes a geographic term, identify the portion of the name that identifies the society or association in the distinctive term, and do not include the geographic term. For example:

Alternate spellings or phonetics

Nuans allows you to add up to 2 different search terms that represent spelling or phonetic variation of the distinctive term in the same language as the proposed name to find better results.

  • The spelling of each additional search term cannot be identical to the proposed corporate name and will be searched as replacement to the distinctive term of your proposed name.
  • We recommend using alternate search terms for single distinctive, or in the case of multiple distinctive, only when each distinctive term have an alternate spelling.

For example, if the name "FX INTERNATIONAL DESIGN" is proposed, where FX is the distinctive term and EFFECTS is identified as an alternate search term, the search will not find matching names that include EFFECTS in combination with FX. North American Industry Classification System (NAICS) codes can be entered to bias business names searches towards names that already exist in the same business sectors.

The North American Industry Classification System (NAICS) Canada 2012 provides a list of NAICS codes and their associated definitions. Please note that while NAICS codes are hierarchically decomposed, Nuans only categorizes businesses at the highest level, meaning that the first 2 digits represent a sector of business.

Currently, only 2 jurisdictions provide data with NAICS codes.

Nuans has created a list of keywords that are associated with specific NAICS codes. As data is loaded into the Nuans system if the record doesn't contain a NAICS code then the system will compare the business name to this keyword list and assign the appropriate NAICS code to the record.

Selecting a NAICS code will cause results associated with the business sector to rank higher in the report. It does not limit the search to the specified sector and relevant results will not be negatively impacted.

To use this functionality, select up to two 2-digit NAICS codes from the drop-down list.

Specifying business activities only cause search results in the same line of business to rank higher in the report. It does not limit the search to businesses operating only in the specified sector.

Specifying goods and services

Users may also specify lines of business to focus on the trademarks search.

For specifying goods and services, the Nice Classification (NCL) codes can be entered to bias trademark searches. In fact, this method resembles how specifying business activities can bias business name searches toward specified business sectors. Nice codes bias the search toward trademarks associated with similar goods and services.

The Nice Classification system is an international classification of goods and services used for the purposes of registering marks. The system is recognized in a number of countries, which makes it easier to apply for trademarks internationally.

Select up to 4 Nice Classification codes from the drop-down list.

Client reference number

You can customise the report by adding a client ID of 14 characters or less in the client reference number field. The client ID will appear on the footer of every page of the report. You can use the client ID to organize search reports by client or to search for specific reports that are associated with a given client. For example:

Results are displayed in groups. The following table shows how the results are sorted to include the most relevant results in the report. It is necessary to review all pages of the report, as you may find highly relevant results on each page.

Nuans sorts the results in this order:

  1. Step 1 – by total score
  2. Step 2 – by status (active first and then inactive)
  3. Step 3 – Sort results with the same score and status (tiebreaker), prioritized in the following order:
    • records that have the shortest names
    • records that are in the most similar order
    • records that have the fewest non-matched terms

My reports

Once you have ordered a report, it will be listed in the table on My reports for 90 days (after that period, it is removed). To get a copy of an older report, refer to the Recover reports function of the dashboard.

Hide reports

At any time, you can hide a report from the table by pressing the Hide button in the Actions column. You can view hidden reports later by checking the View only hidden reports box.

Filter reports

A variety of options is available to filter reports, namely, user who created the report, client reference, date range, company name, report number or view only hidden reports.

View reports

You can view reports in different formats by clicking HTMLPDF or XML in the View report column. You can also download reports in PDF or XML format by selecting one or more reports in the Select column and pressing the Download as PDF or Download as XML button.

If you choose to view a PDF report, the report will display the following 5 sections:

  • Description of the Nuans report
  • Details of the search criteria employed
  • Results for matching corporate names
  • Results for matching trademarks
  • Latest refresh dates for the data cited in the report

Order multiple reports

If you want to order multiple Nuans search reports, select Order multiple reports from the dashboard.

To order multiple reports, enter your search criteria for each report, one at a time, by clicking Add to reports to be ordered. You can copy search criteria from any report as a starting point for another report by clicking on the Copy report criteria icon from the Actions column in the table and then edit the search criteria by clicking on the Update report criteria icon from the Actions column.

Once you have added a report, it appears in the Reports to be ordered table.

At any time, you can delete a report from the order by clicking on the Delete report criteria icon from the Actions column in the table.

Once you have completed entering search criteria for each report that you wish to order, press the Order reports button.

Once you order the reports, you will receive a confirmation of the order and be notified of the 90-day period for which the proposed corporate names will be reserved in Nuans. Ordering a report does not mean that the proposed corporate names have been approved.

To view the reports, click on My reports at the bottom of the notice.

Surveil trademarks

Trademark firms regularly monitor the trademarks that they register to guard against infringement. The Nuans surveillance service is used by trademark agents to determine whether a newly advertised mark conflicts with one of their registered marks. Nuans compares all advertised marks published in the weekly Trademarks Journal against the trademark agents' marks. One Surveillance Service subscription creates a weekly report tailored to the trademark agent(s) identified in the subscription.

The surveil trademarks service will:

  • Search all newly advertised word marks, design descriptions and index headings to identify potential conflicts with the subscribed agent's trademarks
  • Produce a weekly report with potential conflicts for all trademarks registered by a specified trademark agent
  • Ensure discretion by identifying conflicts only via the trademark.

If you want to subscribe to the surveillance service, select Surveil trademarks from the dashboard. Note that there is a fee for each subscription and for each citation.

To set up a surveillance service, press on + Subscribe to the surveillance service button.

Enter a trademark agent number and the desired similarity percentage (the default is 98%) and press the Subscribe button.

Once you have added a trademark agent, it appears in the Surveillance services table.

You can add multiple agents for one surveillance service agreement.

You can stop a surveillance service by clicking on the Suspend the surveillance service icon from the Actions column in the table. You can restart the service by clicking on the Subscribe to the surveillance service icon from the Actions column in the table.

You can edit the surveillance service by clicking on the Modify your subscription icon from the Actions column. At any time, you can delete a surveillance service by clicking on the Unsubscribe from the surveillance service icon from the Actions column in the table.

The surveillance service will run following the weekly update by the trademarks office. Any potential conflicting marks will appear when the surveillance service is run.

To view a report, click on HTMLPDF or XML in the View report column.

The format of the Nuans Surveillance Report is very similar to the extended trademark reports; the advertised mark is presented first, followed by the similar citations. Only marks that have cited similar hits, based on the established similarity percentage, will be displayed in the report. You can also indicate whether you only want to view active marks.

Recover reports

After 180 days, Nuans reports are moved out of My reports and added into the archives. You can retrieve archived reports if they are less than 7 years old. There is a charge to recover a report.

If you want to find and recover an archived report, select Recover reports from the dashboard.

To find a report, enter either the client reference number, the name of the company and/or the date range, then press the Search button.

If one or more reports matching the search criteria are found, the details of the report will be presented in a table that appears at the bottom of the screen.

Remove a reservation report

Nuans reports are only available for 90 days, and the name search reservation report is removed from the database after this period. If you need to remove a reservation report from the database within the 90-day timeframe, please email your request at info@nuans.com.
