The Office of the Superintendent of Bankruptcy (OSB) is advising Licensed Insolvency Trustees (LITs) that several updates to the E-Filing system will take effect on May 28, 2026. These updates introduce additional validation requirements and new submission options for select insolvency filings.
No immediate action is required.
LIT software vendors have received the full technical specifications and have committed to implementing these updates and providing their LIT clients with release notes by April 30, 2026, giving LITs four weeks to prepare and test before the effective date.
Key changes following the system update are as follows:
Form 79
- If a debtor answers “yes” to question 7.1, “In the last six (6) months, have you received professional advice regarding your financial situation other than from the Licensed Insolvency Trustee?”, questions 7.2 to 7.6 on Form 79 will need to be filled out for the form to be accepted.
Forms 60 and 63
- If Form 60 indicates that a Mediation Settlement Agreement has been reached, the LIT will be required to submit an XML Form 63, bundled with Form 60, to the OSB for the submission to be accepted.
Introduce a new "Incomplete" discharge status for certain consumer proposals
- A new discharge status "Incomplete" will permit LITs to submit a Statement of Receipts and Disbursements with a status of "Incomplete" for consumer proposals that have not failed but have also not been fully performed.
