Annex D: Tier 5 service areas for WBS transition

As described in section 10.1.2 decision D17, the WBS stations operating within the metropolitan and urban Tier 5 service areas listed in this table will be required to transition out of the 3650-3700 MHz band by March 31, 2025. The rural and remote Tier 5 service areas not listed as part of table D1 will need to transition by March 31, 2027. The list of rural and remote Tier 5 services are available in the Service areas for competitive licensing table.

Annex F: Conditions of licence for interim authorizations for licence exempt FSS earth stations in the 3700-4200 MHz band and new receive-only FSS earth stations in the 4000-4200 MHz band

The following conditions of licence apply to holders of interim authorizations for licence-exempt FSS earth stations in the 3700-4200 MHz band and for new receive-only FSS earth stations in the 4000-4200 MHz band. It should be noted that interim authorizations are subject to the relevant provisions in the Radiocommunication Act and the Radiocommunication Regulations, as amended from time to time. For example, the Minister of Innovation, Science and Industry (the Minister) continues to have the power to amend the terms and conditions of such authorizations, under paragraph 5(1)(b) of the Radiocommunication Act.

Term: This authorization will expire on the date indicated on the authorization. This authorization is also subject to renewal and termination in accordance with the transition plan and decisions as set out in  the Decision on the Technical and Policy Framework for the 3650-4200 MHz Band and Changes to the Frequency Allocation of the 3500-3650 MHz Band (the Decision).

Future consultation and amendments: This authorization may be amended by the Minister at any time and is subject to the decisions and licensing requirements that will be established following Innovation, Science and Economic Development Canada’s (ISED) consultation on the licensing and fee regime for earth stations.

Fees: This authorization will be subject to fees once they are established following ISED’s consultation on the licensing and fee regime for earth stations or through any other applicable process.

Operation of earth stations: This authorization is limited to “receive-only” earth stations. The holder of this authorization may install, operate or possess systems of identical earth stations as follows:

  1. Earth stations in existence as of the release of the Decision: All earth stations operating as part of a system of identical earth stations for which technical information was provided pursuant to the Decision are authorized for the 3700-4200 MHz band. As of March 31, 2025, the authorized frequency range is reduced to the 4000-4200 MHz band for earth stations operating in non-satellite-dependent areas.
  2. Earth stations established after the release of the Decision: Earth stations are authorized only for the 4000-4200 MHz band.

"Identical earth stations" has the meaning as set out in CPC-2-6-01, Procedure for the Submission of Applications to License Fixed Earth Stations and to Approve the Use of Foreign Satellites in Canada, for the licensing of significant numbers of identical earth stations.

Protection: Earth stations authorized in accordance with paragraph (a) above are afforded protection from 3700-3980 MHz flexible use stations before the transition deadline in all areas, and after the transition deadline in satellite-dependent areas as set out in the Decision.  Earth stations authorized in accordance with paragraph (b) above are afforded protection from flexible use stations operating in the 3700-3980 MHz band in all areas before and after transition. In addition, earth stations authorized in accordance with either paragraph (a) or (b) may not claim protection from licensees operating below 3700 MHz.

Technical acceptability: All earth station equipment must comply on an ongoing basis with the applicable technical requirements as specified in SRSP-101, Technical Requirements for Fixed Earth Stations Operating Above 1 GHz in Space Radiocommunication Services and Earth Stations on board Vessels (ESVs) Operating in the Fixed-Satellite Service.

Radio station installations: The holder of this authorization must comply with CPC-2-0-03, Radiocommunication and Broadcasting Antenna Systems, as amended from time to time.

Provision of technical information: The holder of this authorization must provide, and maintain, up-to-date technical information on each earth station in accordance with the definitions, criteria, frequency and timelines specified by ISED. Site information must be updated at least annually, by March 31 of each year.

Compliance with legislation, regulations and other obligations: The holder of this authorization is subject to, and must comply with, the Radiocommunication Act and the Radiocommunication Regulations, as amended from time to time. The holder of this authorization must use the assigned spectrum in accordance with the Canadian Table of Frequency Allocations and the spectrum policies applicable to this band, as amended from time to time. The authorization is issued on condition that all representations made in relation to obtaining this authorization are all true and complete in every respect.
