Deemed transfer decision
Application
1. On March 3, 2020 (and updated on March 13), Innovation, Science and Economic Development Canada (ISED) received an application for the deemed transfer of twenty-five spectrum licences held by A.B.C. Allen Business Communications LTD. to TELUS Communications Company in British Columbia. Fourteen of the licences are in the Fixed Wireless Access 3500 MHz band and are described in annex A. The remaining eleven licences are in the Wireless Broadband Services and 38 GHz bands and are considered to be non-commercial mobile spectrum licences.
2. The application was reviewed under the relevant provisions of Client Procedures Circular CPC-2-1-23, Licensing Procedure for Spectrum Licences for Terrestrial Services in accordance with SLPB-001-19, Decision on Revisions to the 3500 MHz Band to Accommodate Flexible Use and Preliminary Decisions on Changes to the 3800 MHz Band.

Decision
4. The Deemed Transfer of spectrum licences from A.B.C. Allen Business Communications LTD. to TELUS Communications Company is approved.
Rationale
5. The application was assessed against the policy objectives and criteria set out in section 5.6 of CPC-2-1-23.
6. ISED has determined that the requested Deemed Transfer will not impact the ability of existing and future competitors to provide services given that the transfers will not result in a significant change in spectrum concentration in the affected geographic areas.
