Directive 1R5 - Counselling in Insolvency Matters

Summary

These are the schemas for submissions of Insolvency Counselling Appendix A (Report on Insolvency Counselling Session #1) and Appendix B (Report on Insolvency Counselling Session #2) for Directive 1R5 – Counselling in Insolvency Matters. The following schemas and stylesheets replace Directive 1R4, which came into effect on October 1, 2018.

Starting January 31, 2020, the E-Filing system will allow Directive 1R5 Forms to be submitted to the Office of the Superintendent of Bankruptcy (OSB) in XML format. A copy of the signed Appendix A and/or Appendix B shall be retained in accordance with existing procedures and sent to the OSB upon request. For insolvency counselling sessions completed after the coming into force of Directive 1R5, the LIT shall submit the Report on Insolvency Counselling Session 1 and/or Report on Insolvency Counselling Session 2, in accordance with paragraph 15.

If a bankrupt/consumer debtor did not attend the first counselling session, the LIT must still note this fact on Appendix A, date, sign and e-File accordingly. Appendix B is not required if the bankrupt/consumer debtor did not receive the first counselling session because they deceased prior to or during the administration of the estate or has an incapacity such that it is impossible for them to receive counselling. Non-completion of counselling must be duly noted on the Statement of Receipts and Disbursements.

A new unique XML version number (2020-01) is to be used for these forms.
