Summary

The project is intended to study the effectiveness and fairness for the consumer of mechanisms for accessing justice and legal recourse, so as to suggest improvements or new approaches for Canadian consumers. The report therefore evaluates three concrete methods—legal aid, small claims and class action—designed to improve consumer access to the justice system, in order to suggest better ways for Canadian consumers to access justice. The report identifies the current limits on access to the Canadian justice system by reviewing acts and regulations dealing with these three issues in three Canadian provinces– Quebec, Ontario and British Columbia The report suggests conducting a comparative study, if need be, of similar systems in England and the United States, and presents recommendations resulting from the analyses. The report also analyses France’s Code de la Consommation, which allows consumer associations, under certain circumstances, to appear in legal proceedings on behalf of consumers, and recommends the adoption of similar provisions in Canada. The report looks at legal insurance – the concept, nature of guarantees, exclusions – in order to determine the role of such insurance from the standpoint of increased access to justice.
