The topics in this online help document follow the flow of the stages in Opposition or Section 45 proceedings and are organized by transaction.

To find a help topic for a particular transaction look for the name of the transaction in the table of contents.

If you are an Individual or Organization completing these transactions and you do not have an agent, you may bypass the Agent topics located in this help document. These topics are only for Agents. They contain information about screens that can only be viewed by Agents filing on behalf of their clients who are individuals or organizations.

Opposition Proceedings

First Extension of Time

To request a first extension of time complete the following steps:

  • Select the Opposition proceedings tab
  • Enter the Application number and click Search
  • Use the radio button to select the trademark from the list and click Continue
  • Review the trademark details on the search results page
  • Select File a first extension of time from the Transactions that can be requested drop down menu and click Confirm and proceed
    Note: A first extension of time can be requested within two months of the advertisement of a trademark application
  • Agent
    Note: This section is for agents only. If you are not an agent, you may skip this topic and go to the next step
    • Review the agent of record information and make any edits if required
    • If there is not an appointed agent identified use the radio button to select the agent profile and click Next
      Note: The agent information is linked to the agent profile by contacting the CIPO client service centre
    • Enter the Name of the individual trademark agent (not firm) submitting the correspondence
    • Add a reference number and attention to details (optional)
    • Click Next
  • Click Add a new opponent
    • Opponent information:
      • Select the opponent type: organization or individual
      • Enter the name of the opponent
        • To name any number of persons jointly as opponent(s), you may include their name in the name field by adding "AND" after the first named opponent and between all the other subsequent opponents. For example: First Opponent AND Second Opponent AND so on. Joint Opponent's must provide a single address for correspondence
      • Enter the opponent's main address
      • Enter the opponent telephone number, email address, and reference number (optional)
      • Use the radio button to select the opponent's language of correspondence: English or French
    • Correspondence address
      Note: All correspondence from the Registrar and the other party with respect to this opposition proceeding will be sent to the correspondence address only if the address is within Canada
      • If the opponent's correspondence address is the same as their main address check the box Use opponent address as correspondence address
      • If the opponent's correspondence address is different than their main address enter the address in the available fields
    • Address for Service in Canada
      • If the opponent's correspondence address is not in Canada, enter a Canadian address in the available fields
    • Click save
  • Review the opponent information
    • Click Edit to make any changes to the opponent type, name, address(es), language of correspondence, or click Remove to clear the opponent information and start over
    • If the information is correct click Next
  • Extension of time details
    • Use the radio button to select Request a first extension of time
    • Click on the calendar icon to select the requested deadline
      Note I: The calendar pre-populates the deadline to be the maximum benchmark allowed of 4 months
      Note II: Protocol applications: pursuant to section 125 of the Trademarks Regulations, no further extensions of this deadline are available on request. This includes retroactive extensions of time
    • Enter the reasons in the text box for the extension of time request
      • Attach supporting documentation by clicking Browse (optional)
        • Select the supporting documentation in PDF format
        • Click Upload file
          1. The document will be uploaded and displayed in a table
          2. To add additional documents, repeat the above steps
          3. To remove a document, click the "x" icon
    • Click Next
  • Review and confirm
    • Use this screen to review the transaction request
    • The information is displayed in sections that represent each step of the transaction request
    • Use the Edit icon located to the right of the section name to make a change to the section information
    • Click the Previous button to return to the previous screen
    • Click Confirm and add to cart to move to the next step. If there are any errors that need to be addressed, return to the section where the error occurred to complete the corrections and then return to the Review and confirm screen
    • Click Confirm and add to cart
  • Cart
    • The cart contains transactions that are ready to be submitted
    • To review a PDF or HTML copy of the request click on the links under the Actions column. A link will open in a new window displaying the request
    • To move the transaction back to the work in progress click the "x" icon located under the Actions column
    • The Cart allows for multiple transaction requests. To initiate another request, select an option from the Trademarks Opposition Board E-Services tabs located at the left side of the screen
    • Click Proceed to payment
      • Pay using a credit card or CIPO deposit account
      • Once the payment information is added click Process Transaction
  • Transaction record
    • Review the transaction record details. Save or print this page as the transaction receipt
    • Click Continue
  • Electronic payment confirmation
    • Click Request details to obtain a PDF copy of the transaction request
    • Click Individual receipt to obtain a receipt for individual transaction requests or click Global receipt to obtain a receipt for all transaction submissions

Statement of Opposition

To file a statement of opposition, complete the following steps:

  • Select the Opposition proceedings tab
  • Enter the Application number and click Search
  • Use the radio button to select the trademark from the list and click Continue
  • Review the trademark details on the search results page
    • If a case has already been created locate and verify the Opponent information under List of opposition cases and click on File a statement of opposition under Transactions available
    • If a case has not yet been created select File a statement of opposition from the Transactions that can be requested drop down menu and click Confirm and proceed
      Note: A statement of opposition can be filed within two months of the advertisement of a trademark application
  • Agent
    Note: This section is for agents only. If you are not an agent, you may skip this topic and go to the next step
    • Review the agent of record information and make any edits if required
    • If there is not an appointed agent identified use the radio button to select the agent profile and click Next

    • Opponent information:
      • Select the opponent type: organization or individual

      • If the opponent's correspondence address is not in Canada, enter a Canadian address in the available fields
    • Click save
  • Review the opponent information
    • Click Edit to make any changes to the opponent type, name, address(es), language of correspondence, or click Remove to clear the opponent information and start over
    • If the information is correct click Next
  • Grounds of opposition

Protocol Applications

On this page the grounds of opposition on which an opposition may be based are listed in the form of a drop-down menu. Some grounds may have more than one section which can be selected from the second drop down menu. The Section details expandable link can be clicked on to view a description of each individual section.

Note Protocol Applications: The online system automatically generates the statement of opposition. The Registrar strongly recommends against attaching a statement of opposition in pdf format. Completion of each of the fields in the online form ensures that the Registrar provides the International Bureau (IB) with the information required by Rule 17 of the Regulations under the Madrid Protocol. If an opponent attaches a statement of opposition in pdf format to the online form, any discrepancies between what has been provided through the online form and in the attachment may be resolved against the opponent.

  • Select the ground from the Grounds of opposition drop down menu
    • Select the Section from the second drop down menu
    • Click on Section details to view details for each ground
    • Fill in the required fields, which can vary by ground
    • Click Save
      • Or click Cancel to return to the grounds selection table
    • The ground(s) will be displayed in the Grounds added table
      • To edit the details of a specific ground, click on the edit icon located under the Actions column
      • To remove a ground from the list, click on the "x" icon located under the Actions column

Domestic Applications

  • Follow the above steps to add the grounds using the drop-down menu, or
  • Alternately, Attach the statement of opposition in PDF format identifying the grounds of opposition and click Upload file
    Note: It is not necessary to select the grounds from the drop-down menu AND attach a statement of opposition in PDF format. Please select one method
  • Click Next
  • Review and confirm
    • Use this screen to review the transaction request
    • The information is displayed in sections that represent each step of the transaction request
    • Use the Edit icon located to the right of the section name to make a change to the section information
    • Click the Previous button to return to the previous screen
    • Click Confirm and add to cart to move to the next step. If there are any errors that need to be addressed, return to the section where the error occurred to complete the corrections and then return to the Review and confirm screen
    • Click Confirm and add to cart
  • Cart
    • The cart contains transactions that are ready to be submitted
    • To review a PDF or HTML copy of the request click on the links under the Actions column. A link will open in a new window displaying the request

Counter Statement

To file a counter statement, complete the following steps:

  • Select the Opposition proceedings tab
  • Enter the Application number and click Search
  • Use the radio button to select the trademark from the list and click Continue
  • Locate the opposition case that you are associated with and select Submit a counter statement from the list of Transactions available
  • Agent
    Note: This section is for agents only. If you are not an agent, you may skip this topic and go to the next step
    • Review the agent of record information and make any edits if required
    • If there is not an appointed agent identified use the radio button to select the agent profile and click Next
      Note: The agent information is linked to the agent profile by contacting the CIPO client service centre
    • Enter the Name of the individual trademark agent (not firm) submitting the correspondence
    • Add a reference number and attention to details (optional)
    • Click Next
  • Select one of the following options:
    • The applicant intends to respond to the opposition (no need to attach a counter statement), or
    • The applicant will file their own counter statement
      • Enter the Counter statement text in the text box and/or
      • Attach supporting documentation by clicking Browse (optional)
        • Select the supporting documentation in PDF format
        • Click Upload file
          • The document will be uploaded and displayed in a table
          • To add additional documents, repeat the above steps
          • To remove a document, click the "x" icon
  • Service of counter statement:
    • Select the check box that confirms that a copy of the counter statement has been served on the other party
    • Select the Date served from the calendar
    • Select the Manner used for the service
      • Registered mail
      • Personal service
      • Courier
      • Notice to the other party
      • TMOB e-Services
        • Enter the email address of the other party
        • Select the check box that confirms that the parties have agreed to the service of documents through the Trademarks Opposition Board's e-Services in respect of this proceeding
      • Other manner
        • Enter the other manner in the text box
    • Click Next
  • Review and confirm

  • Review the trademark details on the search results page
  • Locate the opposition case that you are associated with and select Submit evidence from the list of Transactions available

    • If there is not an appointed agent identified use the radio button to select the agent profile and click Next

        • Enter the Name of the deponent (only if affidavit or statutory declaration were selected)
        • Select the Date sworn from the calendar (only if affidavit or statutory declaration were selected)

      • Select the check box that confirms that a copy of the evidence or a statement of no evidence has been served on the other party

  • Review the trademark details on the search results page
  • Select Submit hearing request from the list of Transactions available

      Note: A hearing may be conditional on the other party also requesting to be heard. If both parties' requests are conditional on the other party, a hearing will not be scheduled, and a decision will be issued

      • Enter any additional details or reasons for requesting a longer hearing in the text box

Extensions of Time

Benchmark

To request an extension of time under a benchmark complete the following steps:

Note: The process is identical for filing an Extension of Time request under Benchmark for the Opponent and the Applicant

  • Use the radio button to select the trademark from the list and click Continue
  • Review the trademark details on the search results page
  • Select Request an extension of time from the list of Transactions available

    • Review the agent of record information and make any edits if required
    • If there is not an appointed agent identified use the radio button to select the agent profile and click Next

      Note: Consent from the other party is not required for First Extension of Time to file the Statement of Opposition and Counter Statement Benchmark
    • Requested deadline
    • Enter the reasons in the text box for the extension of time request
      • Attach supporting documentation by clicking Browse (optional)
        • Select the supporting documentation in PDF format
        • Click Upload file
          1. The document will be uploaded and displayed in a table
          2. To add additional documents, repeat the above steps
          3. To remove a document, click the "x" icon
    • Select the check box that confirms that a copy of this submission and any supporting documentation will be forwarded to the other party
    • Click Next

Cooling-off

To request an extension of time under a cooling-off basis complete the following steps:

Note I: The process is identical for filing an Extension of Time request under Cooling-off for the Opponent and the Applicant

Note II: Each party is eligible for receive cooling off extension, up to a maximum of nine months, on consent at any stage up to and including the filing and servicing of applicant's written representations.

  • Select the Opposition proceedings tab
  • Enter the Application number and click Search
  • Use the radio button to select the trademark from the list and click Continue
  • Review the trademark details on the search results page
  • Select Request an extension of time from the list of Transactions available
  • Agent
    Note: This section is for agents only. If you are not an agent, you may skip this topic and go to the next step
    • Review the agent of record information and make any edits if required
    • If there is not an appointed agent identified use the radio button to select the agent profile and click Next

    • If consent has been granted from the other party, select the consent check box (mandatory)
    • Requested deadline

      • Attach supporting documentation by clicking Browse (optional)
        • Select the supporting documentation in PDF format
        • Click Upload file
          1. The document will be uploaded and displayed in a table
          2. To add additional documents, repeat the above steps

Sign in screen

Use this screen to sign into the Trademark Opposition Board E-Filing web application. Your account credentials (Username and Password) allow you to securely access all Innovation, Science and Economic Development Canada online services.

Sign in

Follow the steps below to sign into the application.

  1. Enter your credentials into the Username and Password fields.
    Note: Login credentials are required and they are case sensitive.
  2. Select or deselect the Keep me signed in box.
    Note: If the box is selected, you remain signed in even if you accidently close your browser without clicking the Sign out button. If the Keep me signed in box is not selected, you are signed out if you accidently or purposely, close your browser, without using the Sign out button.
  3. Click the Sign in button to continue to the next screen.

Forgot username or password

  1. Click on the Forgot your username or password? link to continue to the Access Your Account web page.
  2. Follow the screen prompts to manage your Sign in credentials.

Sign up

New Users need to create a login Username and Password. You will use this information to securely access all Innovation, Science and Economic Development Canada online services.

New Users can use the Create an account link which is located under the Sign up label. Clicking this link takes you to the Access Your Account web page where you can create your Sign in credentials.

Proceedings case history

Use this tab to search the case history of a specific Application or Registration. This tab is located on the left-hand menu.

Once entered the application or registration number click the Search button to see the results.

The Proceedings case history screen provides general information about the trademark and a table which displays a list of opposition cases and/or Section 45 cases.

Select the radio button beside the application number of the trademark being searched and click the Continue button.

The Proceedings case history or Section 45 actions history screen appears. Click the View history icon located in the table's View history column for the case being searched to view the history details.

The Opposition case history or Section 45 case history table displays. Information about actions, dates and comments will be displayed for the referred Opposition or Section 45 case.

Click the Close button to close the screen.

Amend a previously filed application

Use this tab to file an amended application on a trademark. This tab is located on the left-hand menu.

Note: Use the tab Amend a previously filed application located in the Trademarks Opposition Board E-Services only if the trademark has an undergoing opposition.

Once the Amend a previously filed application tab is selected a new tab will open redirecting the request to the Trademark E-Services site.

On the Trademark E-Services page select the Amend button and file the amended application. For more information follow the Trademark Online help guide located on the left-hand menu.

Work in progress

Use the Work in progress screen to locate transactions that are in progress and have not yet been submitted.

The left-hand menu selection on the main screen tells you how many transactions are in your Work in progress feature.

Click the Work in progress selection on the left-hand menu and when the screen displays, use the Showing _ entries feature to view the screen entries. The default view is 10 entries, but you can choose to show 25, 50, 100, or All entries.

If there is more than one page of entries, use the Next button to move through the pages.

Use the up and down sort arrows (shown in the column title fields) to sort the items in your Work in progress. You may sort by the column headings:

  • Application number
  • Trademark
  • Transaction type
  • Date modified

Locate the transaction you want to work on and click one of the Action buttons. To view a description of each Action button place your cursor over the icon; a pop-up box displays with a description of what each action button can do. For example, you can use the "x" button to remove a transaction from the Work in Progress list.

Note: You can also view these icons in the Icon legends topic.

Cart

Use this screen to do one of the following:

  • View your transaction request in a new window in (HTML or PDF) format
  • Move your application back to the Work in progress
  • Empty your cart by clicking the button Empty cart
  • Proceed to payment - dollar transaction(s) or Proceed to submission - zero-dollar transaction(s)
    Note: If there is a dollar transaction in the cart the Proceed to payment button takes priority. The Proceed to submission button only shows when there are zero-dollar transactions in the cart.

Payment method

Use this screen to make your dollar amount payments.

Choose your payment method. These methods are Credit card and CIPO deposit account.

Note: You will only see CIPO deposit account if you have already set up an account.

Credit card

If you select the Pay with a Credit Card button, you are taken to a screen where you can enter your credit card details. Click the Process Transaction button to complete your credit card payment. Click the Cancel Transaction button if you wish to return to the Payment method screen without paying.

CIPO deposit account

If you have arranged a payment account with CIPO you can select the Pay with my CIPO deposit account button. In this case you are taken to a screen where you can select your account number and click the Pay now button to complete your payment.

If you do not wish to pay, you may click the Return to previous page link to return to the Payment method screen.

Your order

Use this screen to view and print your Transaction record for dollar amount transactions.

You may print the page and keep it as a transaction receipt.

Click the Continue button to proceed to the next screen.

Electronic payment confirmation

This screen contains your confirmation number and allows you to take the following actions on your transaction.

You can View/Print your Global receipt in HTML or PDF by clicking on the links in the Payment receipt section of the screen.

You may also click any selection shown in the Documents column to:

  • In the Application cell View/Print/Save your Request details in HTML or PDF formats
  • In the Receipts cell View/Print/Save your Individual Receipt in HTML or PDF formats

Note: For the words Global receipt (view PDF) – Clicking on the word Global receipt will take you to the HTML copy. Click view PDF to go to the PDF version of the document.

You may click the Sign out button if you are done, or you may click one of the selections on the left-hand menu to continue with other transactions.

Transaction history

Use this screen to search the history of transactions.

Complete one or more of the fields with criteria. Complete as many fields as you can to narrow your search. Note: The search is limited to a maximum of 1000 results.

The only required field is the End date field.

After you enter your search criteria click the Search button to move to the next screen in the process.

Transaction history search results

Use this screen to review the transaction(s) found based on the criteria you entered on the Transaction history search screen. Use the Showing _ entries feature to view the screen entries. The default view is 10 entries, but you can choose to show 25, 50 or 100 entries.

If there is more than one page of entries, use the Next button to move through the pages.

Once you locate your transaction you can perform the following actions if they are displayed inside the Documents column for your transaction:

Receipts:

  • Global Receipt (View/Print/Save the receipt) in HTML or PDF
  • Individual Receipt (View/Print/Save the receipt) in HTML or PDF

Application:

  • Request details (View/Print/Save the application form) in HTML or PDF
  • Submitted documents (View/Print/Save the application form) in HTML or PDF

Note: For the words Global receipt (PDF) – Clicking on the word Global receipt will take you to the HTML copy. Clicking on the word PDF will take you to the PDF copy the same applies to the Individual receipt and the Application Form.

You may also perform the following action if the following icon is displayed inside the Actions column for your transaction:

  • You can click the Copy your application as a new application icon to place a copy of your application into your Work in Progress as a new application.
  • This allows you to create a new application using an application that contains pre-populated fields. If you wish to change the data in the pre-populated fields, you need to delete the existing data and enter your new data. For example, if your new application uses a different address, change the address to the new address and continue on to the next application step.

Problem report

If you are experiencing technical problems, you can click Problem Report from the left menu.

A separate page will open, the Report a technical problem screen allows to enter information pertaining to the technical problem. When you have completed entering all of the problem information, click the Submit button.

Sign out

The Sign out button is located in the top right-hand side of your screen. Click the button to sign out of the application.

How to view help

It is recommended that you open the help file in a new window. You can then resize your application screen and your help screen available while you complete the fields on the screen. If this is not possible then you can open the help file in a new tab and click between your application screen and the help file screen to get the needed information about completing the field(s) of the screen.

Required fields

The screen itself tells you whether or not you need to enter data into a field.

When a field requires input, you will see a red asterisk (*) and the word (required) in red and in brackets.

Switching languages

The Trademarks Opposition Board E-Services are fully bilingual. You can switch the languages by clicking the Language hyperlink Français or English at the top right corner of each page.

Note: Once you enter to the steps you cannot switch the language without exiting the steps. Once you exit the steps you can use the Language hyperlink to switch languages.

Icon legends

Throughout the E-Services you may see icons that perform actions. Move your cursor over the icon to view the action that the icon performs. The name of the icon appears on the screen.

Below is a list of the icons and what they mean. The icon is shown below followed by its meaning.

  •  -  The Edit icon, click this icon to edit the screen appears on.
  •  -  The Remove icon. This button deletes the item you click on.
    Note: Clicking the X button in the Cart removes the submission from the Cart and moves it back to your Work in Progress. Your application is not deleted.
  •  -  This icon shows the number of entries thar are displayed in a page when there are numerous items found in the search page. This icon has a drop-down menu that allows the selection of 10, 25, 50, 100 or All items.
  •  -  This icon consists of two arrows one pointing up and one pointing down. These arrows are only displayed when there is more than one entry found in the search. Clicking on the arrows puts the results in the order of the column heading.
  •  -  This icon consists of page numbers and the word Next at the end. This icon only displays when there is more than one page of entries to be displayed. Clicking on the page number or the Next button takes the viewer to that page of results.
  •  -  This icon consists of a small green circle with a checkmark inside it. It is used to denote the Successful payment status
  •  -  This icon consists of a red circle with a red x inside it. It is used to denote the Cancelled payment status.
  •  -  This icon consists of a circular arrow shown in a clockwise position. It is used to denote that the transaction is Pending.
  •  -  This icon consists of a small circular arrow shown in a counter-clockwise position. It is referred to as the View history icon. When clicked on, it takes the viewer to the Case history table.
  •  -  This icon it is used to View a document in HTML format.
  •  -  This icon it is used to View a document in PDF format.
  •  -  This icon consists of a circle with a question mark in its center. You can click on it to obtain help.
  •  -  This icon consists of a picture of a printer. It is referred to as Print the review. Appears in the Review and confirm screen of the respective request. When clicked on, it allows the viewer to choose to print a PDF or HTML version copy of the work completed.
  •  -  This icon is used to return to the documents waiting in Work in progress.
  •  -  This icon is used to report a problem. The Report a technical problem screen allows the user to enter information pertaining to a technical problem.
