Summary

In this report, some key ongoing consumer concerns are identified associated with the important elements of the Smart Regulation Initiative. Of particular concern, were those aspects of Smart Regulation proposals that directly touched upon consumer protection in the delivery of important public services. Some of these concerns were advanced in the previously described Reference Group, and hopefully have helped to shape that document. Others some of the ongoing work that is being done in constructing a government Risk Management Framework and the conduct of regulatory impact analysis. The identification of these key consumer concerns has also comprehended the international experience in regulatory reform as well as international reviews of the Canadian experience to date. This material has been incorporated where relevant into this report. Finally, the process of evaluating regulatory frameworks is an ongoing one. A concept which has currency in the discussion of the need for regulatory intervention and effectiveness is one that involves a "life cycle" which incorporates performance review and possible reform as a requirement within the framework that implements the regulation. To some extent the same concept is applicable to the kind of review that is taking place through the Smart Regulation Initiative. In that sense, this report attempts to capture the salient features of the consumer position associated with the scope of the review taking place during the period of this project. The report should assist in the malting of the consumer brief for relevant participation in the regulatory reform process.
