Summary

This research sought answers to the following questions: a) How accurately can we measure or quantify what consumers have gained through class actions affecting them over the last 10 years? What tools are currently available for developing such statistics? b) Can we assume or demonstrate that in class actions, consumers will be better served or will make additional gains when the plaintiff is a consumer association, or such an association is closely involved in the case? c) Does analysis of a sample of consumer cases enable us to identify particular issues or suggest approaches designed to improve procedures for class actions? Action réseau consommateur (ARC), a consumer organization, quickly found that all these aspects could be fairly closely related. ARC sought to study these issues from four points of view. Diagnoses focused on: 1. questions of procedure; 2. questions of communication and information; 3. the management of claims; and 4. questions of funding in relation to class actions.
