Preface

Client Procedures Circular CPC-2-1-30, issue 2, Technical Information Associated with Radiocommunication Installations, replaces CPC-2-1-30, issue 1, dated August 2023.

1. Mandate

The Minister of Innovation, Science and Industry (the Minister), through the Department of Industry Act, the Radiocommunication Act and the Radiocommunication Regulations, with due regard to the objectives of the Telecommunications Act, is responsible for spectrum management in Canada. As such, the Minister is responsible for developing national goals and policies for spectrum utilization and for ensuring effective management of the radio frequency spectrum resource.

Under subparagraph 5(1)(a)(i.1) of the Radiocommunication Act, the Minister may issue spectrum licences for the utilization of specified radio frequencies within a defined geographic area. The Minister may fix the terms and conditions of any such licence, and amend the terms and conditions of any spectrum licence. Furthermore, the Minister may, under subparagraphs 5(1)(h) and (i), require spectrum licence holders to disclose such information as is deemed appropriate respecting the present and proposed use of radio apparatus, as well as any material changes to the aforementioned information.

3. Background

Spectrum licences for terrestrial services are issued for a specific geographic area. Innovation, Science and Economic Development Canada (ISED) requires technical information associated with each radiocommunication installation authorized by the spectrum licence in order to carry out multiple spectrum management responsibilities. ISED collects and publishes technical information on spectrum licences, and its Spectrum Management System (SMS) is a key repository of data on the locations and technical specifications of all deployed radiocommunication installations.

The information collected through the submission of technical information is used by ISED in support of spectrum policy development, compliance verifications, interference investigations, as well as international coordination efforts related to interference along shared borders. The information is also used by licensees in support of their own inter-operator domestic and international coordination, as well as tower and site sharing between licensees, as per the requirements set out under CPC-2-0-17, Conditions of Licence for Mandatory Roaming and Antenna Tower and Site Sharing and to Prohibit Exclusive Site Arrangements. For the purposes stated above, ISED requires that licensees provide certain information to ensure an up-to-date technical database of radiocommunication installations.

4. Application

The requirements of this document apply to all spectrum licences where this document is referred to in conditions of licence. This document sets out requirements related to the submission of technical information associated with radiocommunication installations, and provides additional guidance to licensees.

5. Requirements for the submission of technical information

Licensees are required to provide technical information related to associated in-service radiocommunications installations within one month of the issuance of a licence. Licensees are also required to provide or otherwise update and confirm the accuracy of their data on a monthly basis, regardless of whether any changes have occurred. If there are no radiocommunication installations in service associated to that spectrum licence, the licensee must indicate this as well. Licensees may upload their data more frequently than required, and are encouraged to ensure that technical data on operational installations are up-to-date at all times.

Licensees are required to make use of ISED's Spectrum Management System when submitting technical information related to radiocommunications installations unless, in exceptional circumstances, ISED grants temporary permission to the licensee to use an alternative method. Specific instructions for creating, validating and uploading data, including accepted file formats, are available on ISED's Spectrum Management System.

Annex A of this document contains a list of data elements, which licensees must provide for all radiocommunications installations associated with a spectrum licence covered under this CPC.

6. Additional support

For additional support in providing technical information to ISED, licensees may wish to contact their local district office. A list of ISED's regional and district offices can be found in Radiocommunication Information Circular RIC-66, Addresses and Telephone Numbers of District Offices.

7. Compliance and enforcement of the condition of licence

Where a licensee is found to be in non-compliance with the requirements set out in this document, the licensee may be subject to enforcement action based on a breach of their condition of licence. Potential enforcement actions could include administrative monetary penalties (AMPs), or the suspension or revocation of the licensee's radio authorization.
